Terms of Use

These Terms govern your use of Understory Forecast ("Understory", "the app"), operated by Maya Mushroom LLC ("we", "us"). By using the app you agree to these Terms. If you do not agree, do not use the app.

1. Eligibility

You must be at least 18 years old to use Understory.

2. Educational use only

Understory provides conditions forecasts and species information for education and research. It is not a tool for deciding whether any mushroom is safe to eat. Forecast scores are estimates, not guarantees that any species is present. Never eat a wild mushroom based on this app or any single source. Many edible species have toxic or deadly lookalikes.

3. Your responsibility

You are solely responsible for your foraging decisions, for your safety, and for following all laws, including land access, permit, harvest limit, protected species, and controlled substance laws where you forage. See Foraging laws & ethics.

4. Controlled species

Some species described for identification and safety purposes contain controlled substances. Their pages are for identification only. Understory does not provide forecasts or locations for them and does not encourage their collection or use.

5. Acceptable use

Do not misuse the app, interfere with its operation, scrape it at a rate that burdens the service, or use it for any unlawful purpose.

6. Your content

Your log entries and photos stay on your device and remain yours. We do not receive them.

7. Third-party content and services

The app uses data and images from third parties, credited on the Credits page. Their content remains subject to their own licenses. We are not responsible for third-party services.

8. Disclaimer of warranties

To the fullest extent permitted by law, the app and all information in it are provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, Maya Mushroom LLC and its owners, operators, and contributors are not liable for any illness, injury, death, property damage, legal penalty, or any indirect, incidental, special, or consequential damages arising from use of the app or reliance on its information. To the fullest extent permitted by law, our total liability for any claim will not exceed one hundred US dollars (US$100).

10. Indemnity

To the fullest extent permitted by law, you agree to indemnify Maya Mushroom LLC against claims arising from your foraging activities or your violation of these Terms or the law.

11. Changes and termination

We may update these Terms or change or discontinue the app at any time. Continued use after changes means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of West Virginia, USA, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in or serving Upshur County, West Virginia, unless the law where you live requires otherwise.
